Managing Existing Dealer License

All licensed Dealers, Manufacturers, Distributors, Automotive Recyclers, Brokers, and Auction Services are required to maintain their business information with the Dealer Licensing unit. This is regulated by Arizona Revised Statute Title 28 Chapter 10 Articles 1-4.

Adding or changing a business address, business name, add/delete ownership are example of these processes.

  • When the licensee decides to change the existing business entity, they must reapply with a new application and applicable documentation
    • Example: If a licensee is a sole proprietor and decides to form a Limited Liability Company (L.L.C.), then the licensee will need to reapply as a L.L.C
  • A new motor vehicle dealer license and number will be issued upon processing and completion of the application for a new entity
  • The existing dealer license/plates must be returned to the Dealer Licensing unit for cancellation

A designated family member has the right to succeed in ownership of the existing franchise if the family member provides written notice of the intent to succeed ownership to the manufacturer within 90 days of the owner's death or incapacity.

Upon the manufacturer's request, the designated family member must provide personal business background information to the manufacturer within 45 days of the request.

A manufacturer has the right to refuse to honor the dealer's designated family member to franchise ownership if there is good cause for refusal and must serve notice within 60 days of either the receipt of the family member's notice to succeed or receipt of background information, whichever is later.

The notice of refusal and discontinuance must specify the grounds for both actions. The manufacturer has burden of proof to establish good cause for refusal.

The current license cannot be reassigned or transferred; a new application for a new license must be submitted.
